And we definitely can't let them use statements like that as implications of agreeing with the correct answer. "Trump was certified twice" doesn't explicitly deny "we will attempt to give him a third term."
Fucking SCOTUS proved this. "That's settled law" didn't explicitly say "we will not attempt overturn that settled law," so they overturned it.

Because he knows there's going to be a serious push to get Trump on the ballot in 2028 using "they were non-consecutive terms" as their excuse. And we can't rule out SCOTUS agreeing in the slightest. I'm mean as this point SCOTUS is throwing away in some cases a century of precedent to rule in Trump's favor literally 1/4th of all rulings now.

While I inherently doubt any Trump nominee's ability to serve in any given position, John Marck's response was sadly correct. As a prosecutor, not a Constitutional lawyer, he really should review the relevant subject matter before proffering an opinion. Furthermore a "plain text reading of the Constitution in the 22nd Amendment" only covers eligibility to run, not serve, as President for a third term. Trump is ineligible to be elected a third term, but he is still eligible to serve one. :-( ->

It doesn't help matters that the 22nd Amendment only explicitly covers the office of President while the 12th Amendment only covers eligibility to serve. Had the 22nd Amendment read that you could not run as VP after two terms as President or had the 12th Amendment said you could not run as Vice-President if you were ineligible to run as President we wouldn't be in this state. Frankly, I kinda want to see him try to run as VP just to see if the Democrats will try for Kamala/Obama in response.

What it actually says is: "No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once."

Reading is indeed hard. As much as I hate to say this, there is a difference between eligibility to run for President and eligibility to serve as President, and the 22nd Amendment only covers eligibility to run, not eligibility to serve for the office of Presidency, and the 12th Amendment only covers eligibility to serve in the office of Vice-Presidency. This is an actual loophole of sorts that leaves Trump both ineligible to run *and* eligible to *serve* a third term as President. ->

That last bit is barring any other Amendment or federal law other than the 12th and 22nd Amendments that people have not yet brought up which clearly prevent a two-term President from seeking office as Vice-President or serving in any role in the Presidential chain of succession. I have yet to see anyone bring such laws/Amendments up, but here's hoping something exists because by the "plain text" Trump can still get back in office with enough trumpery.

I don't know if Trump can run. I know that he can't be sworn in to the office and he cannot serve. If he's still alive at that point and he runs, there will be another Jan 6th to prevent the counting of the votes regardless of the election's outcome.
