Under Kentucky Senate succession law (which has been recently twice been updated by the Republican legislators), if he is declared dead after August 3rd, no special election to fill the seat (in the current circumstances, might go to non-maga, or even a Democrat) needs to be held, and the seat can be kept empty until January.
