That is literally how it is now, and the opposite should be true. It's supposed to be innocent till proven guilty, but Police can seize items on the suspicion of a crime or some tenuous connection to crime. In order to get your stuff back, or even partial repayment you have to prove you aren't a criminal. Proving a negative is incredibly difficult and why police usually get to keep whatever they stole because the burden of proof is all on the victim.
