If a suspect feels like they are in custody, Miranda would apply when it comes to questions that could be inculpatory, regardless of whether the police actually mean to have a suspect in custody. If a suspect is sitting on the ground in what the police believe is a consensual encounter, and there are 7 cops looming over the suspect, the suspect is unlikely to feels it's consensual. cont.
