From what I recall, I'm not sure the scottish court ruling would make it so they *couldnt* be arrested for indecent exposure. The ruling was very specifically focused on how the Equal Rights Act in Scotland is worded, for the purposes of that Act, and that Act alone.

Most trans women get hormone treatment, which mostly or completely gives them a typical female setup of hormones. Over a few years, this will cause them to naturally develop breasts. Many trans women aren't happy with the results and get top surgery, breast augmentation surgery, but others are happy with what they get through just the hormones. So if by "real ones" you meant breasts, they're there. If you meant women, trans women are women.

I'm a Military Cook, most times the sneeze guard makes it so I can't see rank or names, we have a few transgender who come in, for a long time I just said, 'Good Day Sir.' or 'Good day Ma'am'. Always respectful, we had one individual walk in and I complimented their nails and hair, but I'd addressed them as Sir, and they politely mentioned that they preferred not to be called either, and smiled when I asked what should I do to avoid upsetting them and asked me to think on it. 1/?

Next day I changed how I greet EVERYONE. "Good day my Friend, what can I get for you." And that's how I address most people now unless I know them personally, everyone is a Friend until they prove themselves otherwise. I'm actually kind of surprised that it's considered indecent exposure for a woman to be topless in the UK. Even here in Texas that isn't illegal (yet). Heavily frowned upon and risking severe harassment, but not criminal.

We're very Prime and Proper over here m8. We dont even really have topless beaches, unlike the rest of the continent where thats pretty common place. Also, alot of our laws are generally based on updated versions of older laws. Hell, you trace the linege of Habias Corpus back about 1000 years or so

I'm actually kind of shocked that Texas doesn't forbid toplessness. Many or most US states do. In New York, even underboob is technically illegal (and yes, it has actually gone to court...). "NY Penal Law §245.01: A person is guilty of exposure if [...] the private or intimate parts of his body are unclothed or exposed. For purposes of this section, the private or intimate parts of a female person shall include that portion of the breast which is below the top of the areola."

A state SC ruling in 1992 amended that; women are free to be topless anywhere men are. The court ruled that to set different standards would be discrimination.
I do find it odd that the law retains its original wording, in light of the ruling amending that law, but I am not a lawologist.

As of this moment, the law I quoted is still on the books, according to the official New York State Senate website: https://www.nysenate.gov/legislation/laws/PEN/245.01 But I don't really know -- I'm Canadian, and just remember reading up on local breast-feeding related laws from when I was spending some time in The States when my kids were little. Possibly things have been challenged or changed since then; but the anti-topless laws are still on the books, as far as I can tell. ¯\_(ツ)_/¯

Its not really agaisnt anyone's will. The court was asked to clarify how the law is written. Unfortunatly, the law is written in a very specific way and the courts are bound to that. It would be dishonest of them to rule the way they believe the people *want* them to rule, and now its up to the elected to change the law. Which is not a difficult problem.
