In general, property owners cannot use deadly force to protect property. But property owners may be able to shoot at trespassers in self-defense if they fear great bodily harm or death. “Ermagods! Theyze stealing mah stuff!” Is not reason enough.

More than likely, adrenaline, excitement in general, running and shooting at the same time was likely. I've thought this too long myself but if you want to disable a vehicle in shortest order possible you need a high powered rifle and shooting the engine block. Even then they can still probably go for a couple miles.

This is the part that constantly gets me. Gun ownership is supposed to inviolate when part of a "well regulated militia." Which means there could, and should, be some damn regulations about who can and can't own a firearm, and under what circumstances, and what kind. I love shooting, love going to the range, love a lot of it, but U.S. gun culture has gone NUTS about reading the first and last phrases in the 2nd amendment and NONE OF THE MIDDLE TEXT.

From what I understand of the federalist papers, the thinking for the 2A was that the federal government couldn't prevent states from purchasing and arming their militias (since, at the time, the thinking was that there would be no federal armed forces except maybe in DC). Then, of course, the SCOTUS warped it into saying every psycho tom dick and harry can have a gun, and the republicans have been working on making sure any sort of regulation is as weak as possible ever since.

Not even that, his affidavit says he thought the kid was trying to break into his /truck/, not even his house. And admitted he thought it looked like they were 'walking away from' his truck before he decided to go out and open fire.
If he gets anything short of an attempted murder charge I'll be kinda surprised.

Attempted murder would never stick. His defense would argue that as he stated he was aiming at the car in an attempt to disable it and successfully hit the vehicle. Aggravated assault with a deadly weapon, property damage, “unlawful/willful/negligent” discharge of a firearm, that’s my bet. None of this is an excuse for this absolute donkey, of course.

Only problem with that defense is you'd have to show your shots were aimed at vehicle disabling points. According to the report his shots largely hit around the cab of the car, with an exceptionally near hit directly at the driver seat even.
Defense would also have to I imagine, likely give justifiable reasons that even "disabling the vehicle" was lawfully warranted, which I can't possibly see them coming up with.

I’m sorry but the defense would only have to create any suspicion that he didn’t intend to commit murder rather than hit the vehicle. It could be to “disable” or “scare”; I would suspect that even arguing he meant to wound rather than kill would be sufficient. Again, this is literal devil’s advocate. Prosecutors will only make a charge they can win.
