Why would they not just say "no, McConnell is still in that seat, go home". An appointed senator would still have to be seated, and no chance that would happen; GOP controlled senate would state the appointment was illegal by Kentucky law (true) and invalid as McConnell hasn't been declared dead (also true).
You're asking Beshear to violate the (albeit unfair) law and put himself in personal jeopardy over a stunt that could not possibly achieve anything useful.

I thought the same thing. I think we’re both incorrect. What I just learned says only the Senate can declare MM unfit for office. Even if they rolled his brain-dead body into Beshear’s office, he couldn’t declare him unfit. And his power doesn’t kick in until the seat is vacant, which means a resignation, death, or expiation from the senate by the senate.
I could be wrong, but just spent an hour going down that rabbit hole.

First, I'm not at all sure that state troopers showing up for a wellness check would not be opposed by McConnell's people and would precipitate a nasty political incident right from the front door. Second, assuming that the officers got in and got footage of the interview (privacy issues notwithstanding), the governor is not a psychologist and not competent to make a judgement; anything he says could be challenged. Sometimes you just have to let shit play out.

No. A bunch of R's were pushing the Aug 3 deadline, because that's the point the govenor would legally have to show that McConnell vacated the position, but backdating that is perfectly reasonable if McConnell is dead. "He's been dead since before the deadline" is still valid, even if the deadline has passed. The actual "deadline" is early Sept, that's when the ball would have to start rolling.

Well the state constitution that specifically states the Governor has the power to appoint people to the Senate if the seat is vacated does, in fact. If a law contradicts the Constitution, in this case a state law contradicting the state Constitution, then the law is invalid. However to get it reviewed by the judiciary it has to be challenged. IE: The Governor appoints someone, the GOP sues about it, and the case goes before the State Supreme Court, who rules on it.

Except that the presence of the 17th amendment adds more complexity. It says the legislature can decide if it’s the governor or not. Add those things together and the best case scenario is that Beshear wins too late. Not a very smart expenditure of political capital. Especially since nothing tells us McConnell is sufficiently ill to qualify as unfit to serve. It seems that way for sure, but “idk what’s going on but it looks super fishy” does not look good on an official document.
