Frame this another way: a civilian is walking towards someone who is slowly retreating from a possible threat when that threat then, unprovoked, releases a chemical agent at said civilian, who was retreating.
Now, if any random citizen walks up to someone and sprays another person, unprovoked, with a chemical agent such as pepper spray, that person would be arrested for misdemeanor assault at the least.

I think he was marking the car because he has low self-esteem and is power tripping. He stopped dead in a flow of traffic to do this. I don't think he had any intent beyond that. As such, what could happen later still doesn't legally justify assault with a deadly weapon.

I don't know what sort of physics you think cars break, but there's no way cars bring in AC air through the hood. AC intake can also be by the windshield. It's not bootlicking to point out shitty logic for assault with a car. If it isn't legally defensible you'll be jailed and stay there. We shouldn't advocate for folks to meaninglessly throw their lives away for shit like this.
