It is not how he operated, it is which offices are included in the 14th amendment as barred. The amendment says "any", but the judge thinks office of the president somehow doesn't fall into that bucket.

I'm willing to give them a pass on having one of their own get shot. And in fairness, their argument is that the insurrectionists didn't use* firearms. As a mater of legality I have to agree that somebody shooting you doesn't prove you were definitely engaged in insurrection. *Apparently "use" means actually discharging them, not just bringing them along.

This is going to end up in the supreme court - who will most likely keep Trump off the ballot. Why? Because Dictators (trump) have no need for a "Supreme" court that can override his decisions.
