Bingo. I'd probably say something. Fuck my life up. Don't say shit. Maybe say, "I want a lawyer", if you're feeling saucy. Or "I will not speak without my attorney present", even if you don't yet have an attorney (you have a legal, constitutional right to an attorney, so no matter what, you'll have a lawyer on your side - period, it's a guarantee, it may not be the best lawyer, but saying shit isn't gonna help).

Say only what your lawyer says you can say. Period.

I hate that this has to be said, but the proper phasing is "i am invoking my 5th amendment right to remain silent and will not answer any further questions until my attorney is present." You need to explicitly invoke your rights and make clear that you are waiting for an attorney. I want a lawyer, where is my lawyer, etc, is too broad, and leaves the door open to argument about intention of the subject and if they actually inviked their right to counsel.

There is no magic phrase. You could say exactly that and some of them will still try to deny you an attorney, and some judges will still let them get away with it.

I'm not saying your phrase is bad or wrong, I'm sure it will work in some cases, but there's no phrase that all cops will just honor.

True, but you the way I phased it provides a much stronger case if it is denied, since precedent has already been set and upheld that any less specific wording is insufficiently vague for asserting your rights. My point being that I want a lawyer, or just remaining silent are known to be insufficient.
