As an active duty serviceman he does not have the same 1st amendment freedoms due to the fact that his conduct is bound by the UCMJ. This will not only impede his career but he could gave serious chats including military prison time. I have mixed emotions on this. On the one hand it's good to see our officers standing up to trump. On the other he WILL be removed from any position where he could shelter his subordinates to any degree from what is happening. I don't see this as a smart play.

That's wishful thinking. Down vote me to hell if you have to, but holding every position of any power or influence is vital to resisting a fascist takeover. Unless there is something of vital importance to be achieved with that action, these symbolic gestures just remove moral individuals from positions of influence to be replaced with bootlicking fascists. Having this man in his actual position when the people stand up and say "NO MORE" would be a far greater benefit than having him in jail

Uniform Code of Military Justice - ALL servicemen basically are held to this whole other second set of laws - that has NO bearing on double jeopordy - so if you get arrested for say, drunk driving - you get what the civilian courts hand out THEN UCMJ fucks you up for the same crime.

The "incommoding" section is the catch-all, unlike other disorderly conduct charges, no "breach of peace" is required for an incommoding charge/conviction. In D.C. you simply have to refuse a "direct lawful order"

Yeah pretty much. This is a whole other conversation, but the steps in front of the SCOTUS have been designated a "non-public forum", the rationale being the Court should remain insulated from attempts to influence/intimidate the Justices. Which isn't dissimilar from protests being banned in front of the Capitol while voting is in session.

According the the Hatch act active duty members are not permitted to protest along political lines in any way that expresses the political opinion of the military as affiliated with any party or political agenda, members of the armed forces can protest any illegal orders or infringements upon the constitution on which they swear oaths to uphold and defend however in openly protesting the president they can also be court-martialed under the UCMJ it's a tricky position to be in.

Technically and I mean this technically he is protesting openly as a U.S. military member for the political agenda of removing the president. That can be viewed as sedition in the court of law. If they were openly protesting a person running for a third term as president 100% ok that's in the constitution. If they were out of uniform this protest would be fine and legal but the hatch act and ucmj are there to prevent the military from adopting let's say a hardlined right wing agenda openly.

ProtestIng an a USMC uniform is illegal. Under DoD Directive 1344.10 (Political Activities by Members of the Armed Forces) and Marine Corps Uniform Regulations (MCO 1020.34H), service members are strictly prohibited from participating in public speeches, marches, rallies, or any public demonstrations in uniform.

Uhhhhhhhhhh that is incorrect. He is in full uniform and active duty. He signed an oath and a contract that he will never criticize the president while active duty in uniform. He did both. He is arrested, he will be court martialed and removed from service. He effectively and immediately ended his service with his protest. He knew the consequences. I don't think there has ever been an instance this has happened. Military ppl follow this rule seriously due to its harsh penalties.
