Already speaking with several other law firms. Below the poverty line anyways. Yet somehow, a credit card from 5 years ago is now being garnished out of my piddly wages as a “student loan.”
This wasn’t for anything related to college. I was denied student loans unless I had a co-signer, which I did not. It was for a car stereo. The amount they are claiming I owe is now $2400 instead of $800. Covid hit, lost everything.
Lawyer up, right?
Accounting department at work isn’t helping and is just letting the pay be garnished. So… looks like another month of Ramen for me…
Changing the classification of a debt like this has to be illegal, right?

You can file a dispute with the credit bureaus and get it removed

Garnishments normally require a court order. Check your local public court records to see if you have a judgement against you first.

Honestly, sounds like they f'd up. By classifying it as a student loan you just have to prove you never had a student loan and the "debt" they own is worthless. At least that's how it worked in Oz when something similar happened to me

Pay a lawyer to get the reason corrected. And you will now owe the lawyer on top of the existing debt.

Couldn’t. Wildfires burned down a bunch of the event venues I worked at in Colorado, had to move across country, was stabbed and then arrested. On disability. Basically, went from… “yeah, I could pay this right now, but I need to build my credit” to “do I eat today or hold off a day or so”

Yeah you have to fight it or it wont change. Check the law in your area, consult and see if you can get it struck from the record for being

Depending on your state they are required to respond within a set time frame, usually in writing. If they don't the debt is null and void. https://dfpi.ca.gov/consumers/managing-debt/debt-collections/know-your-rights/

I guess I have to have the court case I was unaware of reopened. Could be in any of 4 states. No further info beyond the fees they plan to add if I try to reopen it. wtf

Too late. The time for that was BEFORE they got a judge to sign off on garnishment. They sent you a summons for the court date, right?

That didn’t happen for my garnishment. They simply informed my company of the garnishment and they had to comply. 8 months later I was rolled into a class action lawsuit about how they never informed anyone of the impending garnishment. They paid out $13 of the $3500 they took from me. It pays to do wrong apparently.
