The 3 liberal justices mostly agreed with the majority that title IX doesn't prevent these laws. The real fight is the 14A stuff. And Kavanaugh ducked the fight on this one. He never mentions Craig, imports 1A precedent, borrows deference more suited to rational basis review, etc. I think one *could* write an opinion that faces Craig honestly but he didn't...

I have a suspicion that this is about who is liable to compulsory military service, hence the focus on those who are assigned male at birth. They want to make maleness, and thus liability to the draft, something that's assigned at birth and legally immutable.

Most sports aren't men and women. They're "open" and women only. Women have their own sports to exclude bigger and stronger males. The thing we're struggling with is where to draw the line for what counts as female.

But trans women aren't stronger. At first glance it would look like an advantage to start building muscle with the extra support from testosterone and that you get to keep them once on HRT. But you don't. Trans women are no different from cis women in their physical abilities. What advantage they might have had disappears within months. And really, no one gets pumped up with the intent to go on HRT and win in women's sports. Win what? It's not like there are riches to be gained there.

That we have a problem defining who gets to play in women's sports. Women do. It's pretty easy.
If any of the girls or women have a problem with someone, let THEM bring it up on a case by case basis. Women and girls can speak for themselves and don't need some fake, over-arching "protection" that is only meant to terrorize a minority.

The thing that really shifted this entire thing in my POV was realizing their main complaint, the unfair advantage shit, is literally a massive and celebrated part of all sports. No one thought it was unfair Shaq was so big, it was celebrated. Having a genetically unfair advantage against your opponents is something we celebrate, especially in contact sports. It literally only ups the competition, their entire argument stems from being actually anti sports in the USA IMHO.

It sounds like your solution is to not have separate male and female leagues. That means anyone can join any team or league. No more women only sports.

I am actually anti sports in the USA. Youth sports is overly focused on competition bullshit. Just let the kids play. All teams should be co-ed and anybody that wants to play should be allowed in. Contact that could be injurious should be banned. No football, no heading the ball in soccer, etc. Fuck the entire youth sports mythology bullshit we've built in this country.

If I was to say there should be some kind of solution (I don't really think so, let people do things.) this would be it most likely. I'm not as adverse to contact sports, knowing all what we know now, but would handle it like other things that have pros/cons to the body. Wait till their adults, so they can make that decision. That'd fuck up too much money though, too many sports/schools rely on kids being ridiculously invested, then theres the fact I wrestled in highschool and the coach was

literally abusing us at times. Just full throttle insane workouts, teaching kids how to lose weight in seriously unhealthy ways etc. So much could be spun against all that, I could make so many arguments about how bad it was... yet a bit of motivation that sticks with me even at 44 when it was whispered to me at 17 came from coach after an insane workout. I was convinced I was done but he was able through motivation get me to do 10 more push ups. Outside perspective could see that as "old dude
