You're missing the point. Illegal presence is a "civil" matter in that there's no prison sentence, jury trial, or real judge (immigration judges are just lawyers that work for the executive branch), the only "consequences" are arrest, fines, and deportation.
Illegal Entry or Illegal ReEntry after deportation (a misdemeanor and a felony respectively) *can* land you in prison, but most aren't prosecuted because expedited deportation is easier.
Trumps "felonies" were victimless and over paperwork.

As to immigration, the people of a country have a right to say who can and cannot be here. Through our representatives we have established laws regarding proper entry process, and consequences for violations. The severity (or lack thereof) of a punishment is not indicative of the importance of enforcing it. If you incentivize people to break the law through lax enforcement, you inevitably get more people breaking the law; and this is not without consequences for US citizens.

And only crossing by sea had any real processing for them.
Land crossings you could just kind of do in most places with little in the way of requirements or checks involved.

This was never about immigrants. The playbook they're executing requires an "enemy" in order to ratchet up fear and distrust. It isn't logical, and any attempt to rationally disprove the irrational stance is wasted. I hear you, but reality is harder than “go after the employers”. “Knowingly” is the key part. The vast majority of undocumented workers have paperwork that will get them through the government’s e-verify system, which clears the employer of culpability. Everyone knows many of them are faked, especially in certain industries, but they don’t know which ones. The system has to change before you can put criminal liability on business owners in the vast majority of cases.

If anyone really wants to curb immigration, go after the demand. Find companies that employ undocumented immigrants. Fine them heavily. Jail and/or shut them down for repeat offenses. As long as there are jobs that pay immigrants more than they can make back home and provide a better life for their family, they will take the risk. But if you take those jobs away, they’ll stop coming. But, most politicians only want to appear tough on immigration, but still want the benefits of cheap labor.

Nah, go the other way. Make it super easy to get a work permit, but have higher taxes so they have to demand higher wages. Give them extra protections. AND, here’s the important part, give whistleblower protections to immigrant workers and actually use them. Boss pressuring American workers to clock out and finish off the clock, nbd. Doing it to someone with a work permit, if they get it in writing or record it, business is fined 10 year’s salary and the worker gets 20%.

That’s the problem: the workers do have documents in most cases (all cases at larger employers). E-verify, which most large employers are required to use and accept, is easily faked. A company like Tyson Foods, which might have hundreds of undocumented workers at a single site, has checked every one of them in e-verify, which covers them legally. You can go after the smaller employers who DGAF, but it’s not a solution. Really clamping down on this requires biometric ID cards.

Many states (but not Texas) have required e-verify, with exemptions for smaller employers. The result was one season of crops not getting harvested, and then workers figuring out how easy it was to fake e-verify. So the end result is larger employers still employing the same people, but having legal cover to do so because “we checked with the gubment”. Whoops.

Also no. The usual, previous response was to create a case, and give them due process which includes hearings to see if they qualify for asylum, or any other paths to citizenship. They get counsel, a judge, they aren't in jail, they aren't snatched off the street, and flown to private prisons. If I was accused of a misdemeanor I'd expect to pay a fine and go about my life.

Look at the level of response from ICE/CBP & compare that with the supposed severity of the ostensible "crimes". Does anyone deserve to be beaten, abducted, denied due process, & shipped off to a third-party concentration/death camp for something that's on par with, say, driving 5mph over the speed limit or jaywalking? And that's not even accounting for the objective benefits of having immigrants--regardless of "status"-- in our work force.
