I've been fostering my daughter since she was born and she's almost 8. She wants to have our last name but it's still getting worked out on the courts. Luckily, her school district respects "preferred name" and so she uses her "first name, our last name" as her preferred name. Her previous, more conservative school district did not allow that.

I've used this tactic before, be careful with the fragile ego's of weak men though. Maybe because I'm an asshole myself but when I hear someone whining about pronouns, specifically a group of men I know out here, I just start calling them Ma'am and little lady until they get pissed off.

I did it to my mom when my oldest came out to her as NB and she threw a hissy fit. She eventually changed her tune and sort of tries to put in an effort to apologize when she realizes she's misgendering them.

They/them would be smarter for people who aren't ready to throw hands, nothing makes insecure men go right to rage than being compared to the women they see as lessor. That combined with the reality of how they actually DO care about pronouns (aka I make them realize they're wrong). Its only happened once, I'll be honest, but it was therapeutic. Dude lost his shit while some of his buddies figured it out and laughed at him. I was ready to throw hands, anger issues on this end.

That’s why they/them is my go to. I just pretend they are a dog and I don’t know what gender they are, and I them with kindness. I think most men have had it hammered into them “don’t be a girl” their whole lives, misgendering can trigger anger. But removing gender isn’t something they expect, so their confusion can be disarming.

Unfortunately they worded the law in a way that employees aren’t protected from ‘adverse employment action’ if they use pronouns inconsistent with the sex listed on a person’s birth certificate as listed near time of birth. They would probably be happy if employers fired a bunch of people for this form of protest.

That’s the insidious thing, you misgender your boss and they can fire you. If you sue them then you’re suing them for what? a positive right to intentionally misgender a person at work?
More likely the legal challenge that could actually get somewhere is that a trans person sues for equal protection: if someone’s birth assigned gender gets legal exceptions then someone’s expressed gender must be afforded the same exceptions for the law to not be sex discrimination. Good luck with SCOTUS.

I don’t think current federal anti-discrimination laws are sufficient to protect transgender rights. Laws like this one are structured to survive legal challenges and poke holes in previous legal precedents that constitute current protections. We should recognize that we may have legal (or at least more-legal) discrimination soon. There may not be a cute answer to it. There may not be help coming from the legal system. If so we need to show the harm to win votes to stop it.

Prediction: this law is going to take effect and they are going to protest by misgendering other people (to make a point) and lose their job and be absolutely flabbergasted that the law doesn’t protect THEM from misgendering people and some of them will happily take it through appeals but other people are going to defend misgendering people on the news and social media and some of them are going to be upset that they got fired for misgendering someone &transphobes are going to just eat it up.
