Because without that people realize that SCOTUS has 0 enforcement ability for their rulings. SCOTUS rulings had power because the institution was regarded as largely impartial and fair and working to adjudicate disputes between the executive and legislative branch in a well reasoned and lawful manner. Take that away and you have 9 people who dress up in robes and like to hit things with a gavel - which is what we have now.

Just to make it clear which facts she feels are ignored.

Sotomayor’s point was not that biological males have no athletic advantage. Her point was that the Court treated the state’s rule as valid without giving much weight to case-specific cases, such as whether this particular athlete had actually gone through male puberty or retained a competitive advantage.

So it’s not really a denial of biological differences. It’s an argument that blanket bans ignore individual cases

This is so confusing. It states that this was said TO the supreme court, like the dissenting opinion is that the facts don't matter.

This was said to REPRESENT the ruling, to mock it, and references the facts that studies do not show trans athletes having an inherent athletic advantage. These didn't matter to the ruling that excluded trans athletes.

I have no issues with trans people. As a bisexual, I don't think I'd have an issue dating either side of that equation, but even after hormone therapy, a person born male is, on average, still stronger than a woman. I agree with the court.

Our testosterone levels are medically suppressed, unlike cis women, which leads to significant muscle loss. Meanwhile, the larger and heavier skeleton is permanent. Trans women don't have the physical advantage in most sports that you might think.

Especially when we're talking about high-school sports, where the girls might not even have had significant testosterone exposure before transitioning.

I think like, every actual serious study into the physical stats of trans athletes has shown that after ~2 years of being on HRT their body will have functionally identical stats to that of a person of the same size/weight and opposite assigned sex. The "issue" is so much of a manufactured nothingburger that it is insane. Even when they weren't legislated into oblivion, trans people did NOT dominate in ANY kinds of sports.
