Granted, the number is low, about 10 dead kids (could not find data on how many kids were saved, with intervention, after choking on the toy inside...)
Also, it is poor culinary practice to put anything inedible on the plate, this is why all garnishes are edible (if not exactly tasty).
I get your point, but the top is clearly encased in a separate container inside the chocolate egg, which itself is too large for any non-serpent child to ingest whole.
I remember buying one when I lived in Germany, I still have the toy, a cute little grey mouse thingy... for some reason I remember it inside a separate egg thingy... also, the chocolate was not as good as Dove or the Belgian stuff I was getting at the time...
