To answer your question, yes, he can do that. Ex-Presidents keep their clearance and receive briefings as a courtesy and a benefit to the current Administration. That is, they are kept up to date in case the current President wants to consult with them on something that happened in the last Administration. That does happen when we have real Presidents and not assholes like Trump in office.

BTW, I can think of one thing he already ordered that was probably illegal. The dumping of the Dam reservoir water storage locations in California after the fire. He literally ordered his people to do that out of spite.
