his thing to do is ask the state legislature to call a special election because the seat is vacant. can't do that until the seat is declared vacant, this is all his attempt to get the seat declared vacant cause noone with the power to do so(republicans) will admit to it.

Okay... this does make some sense; it would be nice if Beshear admitted such a thing, though. Because so far I've been very disappointed with how Beshear has dragged his feet on this matter. We might have only pretended to be represented with McConnell in office, but right now we have no representation what-so-ever.
If it is entirely up to Republicans in KY Congress, I doubt any efforts by anyone will convince them to declare the seat vacant... but we can try.

When you're dealing with an election that would be months away, for a position that would be filled for months away, temporarily "getting away" with saying there will be a special election would be pointless. If the gov can't prove he's legally in the right to call for a special election there won't be one, regardless of what he says or does today. He /has/ to establish a proper chain of evidence to make what he does stick because he cares about actually accomplishing shit instead of just talk.

Here's the thing. If this hypothetical situation were to happen and this were to hypothetically go to court. The case would not be "Is Mitch McConnell dead?" or "Is the Governor allowed to appoint Senators?" it would be "Was the seat properly vacated when the Governor declared a special election" which, regardless of whether or not Mitch McConnell is alive, dead, or a vegetable, would be no.

On top of that, we're looking at 5 months until the term is over. They aren't going to seat any replacement or hold any election while that is pending in court. Logistically, it'll take months just to get it in front of the court. So literally all you would be doing is picking a fight over whether or not you can waste everyone's time just to spite the idea of Mitch McConnell
