So, I am wary of banning anyone's form of expression... if the 1st Amendment will protect a Nazi (I would argue you have no right to be masked while waving your swastika or Confederate/Nazi flag), it will protect a trans person and their expression.
However, what we end up doing is protecting Nazis and terrorizing trans folk.
It isn't the protection of some speech that is the problem, it is how we annihilate other's speech/expression/existence.
They should have been allowed back in as states... I don't have an issue with that... however, reconstruction didn't go far enough and perhaps they should have been Territories again first, there should have been executions of confederate officials. And if there was resistance, redraw their borders, shatter the old state lines, destroy old state loyalties within a generation or two.
We allowed local Nazis to live in WW2, and invited more over to America after WW2, both through Operation Paperclip and just bringing them over. We let them carry on their old rhetoric. We were soft on the Confederates. We cared too much about our image and not enough about our safety.
