I'd say proof of life isn't enough. Proof of competency should be included. It's possible he had a stroke and is alive but unable to communicate or understand what's going on. That would also necessitate a special election while eliminating technicalities.

You don't get it, it's illegal for him to go that until the seat is vacant, he either has to be expelled, resign, or be declared dead, so anyone can challenge the special election, not just McConnell, he literally doesn't have to make an appearance throughout the entire ordeal.

If you were proven to be deceased, the Governor of Kentucky would call a special election and the people would vote. Kentucky is not allowed to appoint someone to fill a vacant seat in Congress.

The seat has to become vacant prior to the August deadline to allow a special election. The seat remains vacant after the deadline passes. That makes people assume that Mitch is on ice until the deadline passes, forcing the seat to remain unfilled by default.
