The US isn't apart of the ICC. The way our constitution is written makes it incompatible. The US supreme court has to be the highest court recognized in the land. The ICC lacks elements guaranteed by the constitution like having a jury of your peers, a right to a speedy and public trial, protection against retrials if acquitted etc. To recognize the ICC would require amendments to the constitution which was last done a decade before the ICC was founded. Good luck passing a 2/3 majority right now
The US actively oppose the ICC. They have a law in place to protect their citizens against prosecution. Israel does recognize the ICC and Netanyahu has avoided visiting countries that do too. But the US are safe for him.

Being “on the hook” is not the same as having an active arrest warrant from the ICC. Surprise surprise the US and Israel are not legally bound to arrest him because they’re not members of the ICC. The US isn't apart of the ICC. The way our constitution is written makes it incompatible. The US supreme court has to be the highest court recognized in the land. The ICC lacks elements guaranteed by the constitution like having a jury of your peers, a right to a speedy and public trial, protection against retrials if acquitted etc. To recognize the ICC would require amendments to the constitution which was last done a decade before the ICC was founded. Good luck passing a 2/3 majority right now

The US actively oppose the ICC. They have a law in place to protect their citizens against prosecution. Israel does recognize the ICC and Netanyahu has avoided visiting countries that do too. But the US are safe for him.
