The law isn't "The Governor declares and election to fill the seat whenever he declares that the seat is vacant" its "The Governor declares an election when the seat BECOMES vacant." The case does not depend on whether or not McConnell is a vegetable, but on whether the seat was vacant at the time of the announcement of the special election, which requires either Mitch McConnell being officially pronounced dead or for him to have stepped down. Still wouldn't work. If you haven't figured it out yet, Trump can only do shit that Congress (or more accurately, the Republican members of Congress) are the mechanism by which he is stopped. It's not worth doing much more than demand transparency on this issue. Say it, magically works out and no Republicans fight back and the aides Weekend and Bernie'ing Mitch's corpse go "awe schucks, you got us." We'd get a special election in November, to fill a seat for a grand total 2 months, before it is filled by the winner of the General election, that was held the same day as the special election.
