It's probably not a non-compete. He's probably still under contract at Fox, and getting paid for it (either lump sum or ongoing payment) they just don't utilize his services.

That's still a non-compete. There are contracts that will still allow you to work elsewhere while under them. Non-compete is just the name of a clause that can be in a contract. The terms of the non-compete can vary and include enforcement after the contract period ends.

His contract is currently the equivalent of the "catch and kill" Stormy Daniels shit Drumph and his tabloid pal were up to in 2016. Fox gets exclusive use of his services for $X for the duration. They could mutually terminate the contract since Fox has no intention of putting him on air again and Tucker craves the attention but it's worth more to Fox to keep him off a competing network and so he's locked in.

It really depends on the wording of the contract. I've heard of cases where a talent buys out his contract, effectively betting on themselves, and are no longer held by it's provisions but those are rare cases.

Tons of companies have binding contracts for even after you are no longer with the company. You can look up non-compete clauses for more info, that is usually how they look. But considering this is Fox, they probably have an air tight contract that is binding at minimum for 1 to 2 years after separating

My understanding is that he was let go but Fox was still going to honor the rest of his contract, something a bit over $20 million. At the very least he forfeits that and maybe more penalties due to non-compete clauses or something

I mean he was fired, but positions like his have contracts and part of his go away contract was a fat payday, golden parashoot, by paying him they dont violate the laws that prevent you from getting another job, non-compete contacts dont hold up in court. . He violated that contract and they knew he would, so it most likely had very nasty language that gives Fox all the power. And they will silence him and then drag the case out for as long as tehy can to break him.

Some places have a noncompete clause. When I started at a previous job, I had to agree not to do business with/work for a related company for 6 months after parting ways with them. Didn't matter though, covid crushed them out of existence.

I agree but on the other hand, those clauses exist for a reason. Some employees have enough power by virtue of their insider knowledge and their connections to the company's clients that they could start a competing firm and completely devastate their former employer using the resources that the company gave them. But on the other hand, a non-compete seems to skew too far in the company's favor over the individual so I don't think it's a good solution.

That might've been true in the 2000s when the costs of starting a company were relatively low. Today it's delusional - both Ubisoft and EA made me sign a non-compete, as if my 2-man studio has the resources to release a AAA product and compete with them.

Honestly, even without CraftyGiant's recent ruling, I doubt that specific company's would have been enforceable; they were pretty paranoid and over-aggressive with stuff. But the general idea was that, if say they were an advertising firm for fast food companies, just don't work with fast food companies in terms of advertising. Crappy, but not impossible to deal with.

These are typically only used for people in high profile industries who are getting headhunted anyway. Whatever company poaches them just find a shell company to pay them under til their non-compete runs out.

IANAL but I would guess that you're under contract to that specific company and, if that company doesn't exist, then any contracts would be voided since there's nobody to be under contract with.

Don't know exactly different laws but you can't take away a person's ability to earn a living. If he is still being paid his earnings aren't hurting so I think they can enforce the contract.
