To actually have good public transportation you need to clean that shit up and patrol the cars. But yelling at a black dude eating a sandwich isn’t really them trying to make public transportation better, it’s just cops power tripping, and to a lesser extent, a guy being belligerent back who could’ve easily just listened to a warning instead of escalating.

resisting arrest is so vaguely defined in many cases that way cops can apply it to anything as simple as the person taking a step backwards away from a cop when they approach. Its a tool used to 'legally' arrest anyone if they want to.

yes its an additional charge to tack on. The problem is, they can make up ANYTHING for the arrest. And then say you resisted for any reason they want and even if the bogus jaywalking or drug accusation used in the initial arrest goes nowhere cuz it was made up, they can still use that resisting as a way to fine you or make you do state sanctioned slave labor, or if you on probation, send you back to the slammer.

No they cannot make up anything. They must have a clear and defined reason to stop you and ask for your ID. And fun enough in california j-walking doesn't count. Eating on a sidewalk doesn't count. The best course of action is to just let them arrest you for whatever made up thing is and then sue them.

. . . you've never actually met a cop have you. Cops make stuff up all the time. They are also infamous for carrying around bags of drugs and planting them in cars during 'reasonable searches.' Not to mention, police dogs are a fuckin scam. They are trained to alert based on the cop's actions to give them a 'reason' to suspect something. Almost everything about policing is made up. Yes including fucking fingerprinting.

Some of the stations sell food too, which can be misleading because you're not supposed to eat it inside after you buy it and BART police will appear out of nowhere to remind you of the rules. That said, I've seen wild shit on BART that the police never responded to over the course of several stops, so priorities seem to be out of whack.

Bylaws are an arbitrary list of excuses for any police officer to unlawfully detain anyone. They don't even have to exist, and the officer does not need to explain themselves. They have the legal right to lie.
This was not an arrestable offense, but a fine. A police grabbing the hand of a citizen is not resisting arrest.
A-fuckin-CAB, every pig knows that the first way to escalate any situation is to aggressively detain someone, and then claim they are resisting arrest for not dying.

It's a law that is specific to a subsection of infrastructure or district that is secondary to the state or provincial law is a bylaw. It's the same umbrella that governs noise pollution and block parties. It cannot be an arrestable offense without escalation, and YET--
look at that cop. He begins by grabbing the man's shoulder. Nothing about that law is arrestable, but he BEGINS by laying hands and saying "you are under arrest". He knows that any response that isn't "yes, please" is resistance

Officer started to issue a citation, but EAH wouldn't provide ID, cussed him out and apparently called him a homophobic slur. The video then begins with EAH acting oppressed. EAH is the bad guy here.
