According to the EPA in 2007, a riding mower emitted as much hourly pollution as 34 new cars. That's a 4 stroke moped, so it is not like they haven't been around since like forever. (Dutch moped is under 50cc or 30 cubic inches).

AFAIK it generally revolves around signaling (brake lights, turn signals, headlights) and being both large enough to be visible and powerful enough to not impede traffic. You would still need to obtain a registration and license plate, but there are plenty of small ATVs that are ‘street legal’ but still well below a full car in many ways.
Fun fact. In the USA If you are disabled and need a mobility aid a trike will do. If a business tries to tell you no they need an articulable reason why it would be unsafe for you to use it. Now a lot of restaurants will win cause narrow aisles and table seating. But big box stores and many movie theaters even gotta let you. Just keep it as tame as possible. I know one dude tried to use an ATV and that did not work at all.
You can insure just about anything, though you WILL pay for it. Most places require you to have insurance but there are some that don’t. And at the end of the day, it’s a civil infraction. For some people a fine is just a fee for getting caught having fun.

Our roads are different from EU roads, a lot of them are older and don't even have rebar in them. The weight is an actual deal breaker alone as it would damage most non-highway roads. I'm sure they have other issues with it, but that alone is likely enough to ensure it never gets accepted. Thing weighs more than any other consumer vehicle I know of. It's why it has to have those huge tires on it that don't last too.
