I remember the Justice League alternate universe two-parter with the Justice Lords, who had a habit of Superman laser-vision lobotomizing career criminals, notable for two burn marks on their foreheads... however, for The Ventriloquist, the burn marks were on the Scarface dummy, not the man.

Its been both. Some versions have it as just a doll where the ventriloquist feels comfortable acting as a criminal, others have given it mystical powers that posses the ventriloquist. I think the non mystical version is better.
